1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Vizozo s.r.o. ("Company", "we", "us", "our") concerning your access to and use of the Cooksy mobile application and website at cooksy.techsorbit.com (collectively, the "Service").

By using the Service, you agree to:

• Be bound by these Terms and our Privacy Policy
• Comply with all applicable laws and regulations
• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Provide accurate and complete registration information

If you do not agree to these Terms, you must not use the Service.

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

3.2 Account Eligibility

• You must be at least 13 years old to use the Service
• Users under 18 require parental/guardian consent
• You may not create an account if previously banned
• One person per account (no account sharing)

4. User Content and Intellectual Property

4.1 Your Content Ownership

You retain all ownership rights to the recipes, photos, and content you create and upload ("User Content"). However, by posting User Content, you grant us a license to use it.

4.2 License to Your Content

When you post User Content, you grant Cooksy a:

• Worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content
• Right to use your content for Service operation, promotion, and improvement
• Right to display your public recipes to other users
• Right to create derivative works (e.g., translations, optimizations)

Note: This license ends when you delete your content or account, except for content shared with other users.

4.3 Content Standards

Your User Content must NOT:

• Violate any intellectual property rights (no plagiarized recipes without attribution)
• Contain illegal, harmful, threatening, abusive, or hateful content
• Include personal information of others without consent
• Contain spam, advertising, or promotional material (unless authorized)
• Include sexually explicit, violent, or disturbing content
• Impersonate any person or entity
• Contain malware, viruses, or malicious code

4.4 Recipe Attribution

If you post a recipe created by someone else, you must provide proper attribution and credit. Cooksy respects intellectual property rights and expects users to do the same.

4.5 Cooksy's Intellectual Property

The Service, including its design, features, code, logos, and trademarks, is owned by Vizozo s.r.o. and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or reverse engineer the Service
• Use our trademarks without permission
• Remove copyright or proprietary notices
• Create derivative works based on the Service

5. Subscriptions and Payments

5.1 Subscription Tiers

5.2 Billing and Renewal

• Subscriptions auto-renew unless cancelled before the renewal date
• You will be charged at the start of each billing period
• Prices are subject to change with 30 days' notice
• Payment is processed through Google Play or Apple App Store

5.3 Free Trials

We may offer free trials (typically 7 days). You will be charged when the trial ends unless you cancel before the trial period expires.

5.4 Cancellation and Refunds

• You can cancel your subscription anytime through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused features
• Refund requests must go through Google Play or Apple App Store
• We reserve the right to issue refunds at our discretion

7.1 Our Rights

We reserve the right to:

• Review, monitor, and moderate all User Content
• Remove or modify content that violates these Terms
• Suspend or terminate accounts for violations

8. Third-Party Services and Advertising

8.1 Third-Party Services

The Service uses third-party services including:

• Firebase (Google) - Authentication, database, storage
• Cloudinary - Image hosting
• Google Sign-In - Authentication
• Google Cloud Translation - Recipe translation

These services have their own terms and privacy policies. We are not responsible for third-party services.

8.2 Advertising (Google AdMob)

Free tier users will see advertisements through Google AdMob. By using the free tier, you consent to viewing ads. You can remove ads by upgrading to Premium or Pro.

EU users will be asked for consent before personalized ads are shown.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIZOZO S.R.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

9.4 No Medical/Nutritional Advice

The Service does not provide medical, nutritional, or dietary advice. Consult healthcare professionals for specific dietary needs, allergies, or health conditions.

10. Termination

10.1 Termination by You

You may delete your account at any time through the app settings.

10.2 Termination by Us

We may suspend or terminate your account immediately for:

• Violation of these Terms
• Illegal activity or fraud
• Abuse or harassment of other users
• Non-payment of subscription fees
• Extended inactivity (with notice)

10.3 Effect of Termination

• Your access to the Service ends immediately
• Your User Content may be deleted (see Privacy Policy for data retention)
• No refunds for terminated accounts (unless required by law)
• Certain provisions survive termination (e.g., intellectual property, limitations of liability)

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Slovakia, without regard to conflict of law principles.

11.2 EU Consumer Rights

If you are an EU consumer, you benefit from mandatory consumer protection laws in your country of residence.

11.3 Dispute Resolution

Before filing a lawsuit, you agree to:

1. Contact us at support@techsorbit.com to resolve the dispute informally
2. Provide a detailed description of the dispute
3. Give us 30 days to attempt resolution

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via:

• Email to your registered address
• In-app notification
• Notice on our website

Continued use of the Service after changes constitutes acceptance. If you don't agree to the new Terms, you must stop using the Service and delete your account.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cooksy.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

13.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

13.4 Assignment

You may not assign these Terms. We may assign our rights to any affiliate or successor.

13.5 Translation

These Terms may be translated. In case of conflict, the English version prevails.
